Abstract

The aim of this essay is to explore the most significant reflections of South American legal historiography methodological trend. In this present case, the focus is on the Italian penal positivist thought, which spread through-out Latin America between the nineteenth and twentieth centuries. The survey does not claim to provide a complete bibliography, but it rather favors a path that identifies themes and cues that can allow multiple and new interpretations.
